There it is. Thanks so much. Good evening. My name is Justin Antwitz. I was a resident of Everett for quite some time. I moved on to Lynn. I'm the chair of the Wage Theft Advisory Committee in Lynn. I helped other cities and towns address ordinances that end exploitation of workers. Well, it doesn't end, but we like it to end exploitation of workers. And we've had Attorney General office, Fair Labor Division come and testify in settings like this on behalf of the ordinances that we've been passing. and they helped us really kind of come up with the language that should exist within these communities so that we can better protect workers, better protect the cities themselves through their procurement processes and allow for the city itself to have particular functions and tools in their toolbox to address some of the concerns that they might not have had previously. One of these things being in my community we had a development that came in.

We found misclassification, wage theft, other fraud that was going on. and the city itself didn't have a function to go through. We were able to refer to the Attorney General's Office and the Department of Labor, but that took three years for them to come up with resolutions. had the city had some kind of tool or mechanism to help out with that, we think that the workers wouldn't have to wait three years for the nearly half a million dollars in restitutions that came to them and to the state coffers because the city would have more of that those tools to address those concerns and running out of time.

I'm the political and legislative director for the North Atlantic States Carpenters. I'm here just to speak in support of the wage theft. I'll be real quick. We appreciate the opportunity for us all to get our few moments in here. As mentioned before, This wage theft ordinance is going to protect workers who too often are exploited in the construction industry as well as other service sectors. as well. It protects honest contractors who have to compete when they do the right thing by paying taxes, by providing things like workers' compensation, and making sure folks have access to things like unemployment insurance. They have to compete against contractors that don't and therefore put it at disadvantage. And there's almost an incentive to do the wrong thing versus the right thing. And then third, wage theft hurts all taxpayers in the Commonwealth and here in the city.

The reality is when dishonest contractors and vendors are not paying their appropriate taxes, they're not paying into the unemployment system, into the workers' compensation That costs everyone. Everyone here in the city of Everett and everyone here across the Commonwealth. And I would offer a couple quick things to say that cities like Worcester have passed this ordinance, taken action to kind of take action against dishonest contractors who are cheating their workers as well as kind of putting themselves at disadvantage on honest contractors. And then more recently, Governor The governor, actually, through the Executive Office of Housing and Livable Communities, has passed a responsible contractor guidance that is largely based on this idea and the language of the wage theft ordinance, saying that if you're going to use Public money to build affordable housing with things like tax credits and tax incentives from the state that you have to follow very similar language that's in this ordinance. So the idea here is we're trying to raise the bar locally as well as across the Commonwealth. Thank you.

They're pointing together a presentation for the planning board on more of the logistics of how something like this would work in practice and be enforced. So I think that's something that we would be happy to share with city council. just to make sure we can execute this and make sure that workers are being protected, things are being built safely and fairly. Why do you insist on calling the general fund balance free cash? If you have extra money, haven't you overtaxed the taxpayers? Considering the whopping tax increases we have just experienced, I think you should take a very close look at the budget. You passed and see where you might have been able to cut the increases you gave out. How do you know what the water and sewer emergency repairs are going to cost? So why are you looking for $150,000? Do you already have repairs that need to be made? If so, why aren't they listed? I'd like to know what your plans are for all of the money in the account you call free cash. Common sense tells you that there must be a plan for this money. I'd like to know what it is. How are you going to update the rules for public participation? Do you want to give us less time because the school committee does? Remember, we have three separate branches in our city government, the mayor, the council, and the school committee, and they should all be independent. Do you want to forbid us to talk about certain topics? Forbid us to question the majority of the time, never get answers?

We show you respect and sit and listen to what you have to say, perhaps you could show us some respect by changing the agenda items to three minutes and leaving non-agenda items at two minutes. Reducing public speaking doesn't promote a democracy. It hinders it. The fire suppression apparatus equipment should have been part of the original budget. Our fire and police departments should have every piece of equipment they need. It shouldn't be an afterthought. Remember, these are people that run into danger while everyone else is running away from it. I think it's time we use some common sense in regards to our budget. Why do we need another bike station?

I could go on and on, but I think you know what I'm asking. We need to treat the city's budget like we would treat our own family's budget.

Good evening. With all the issues facing the residents, the agenda items totally ignore the reality and concerns that people are ever facing. First, regarding the ordinance for fair wages, can I kindly ask before you add any more ordinances, you work on enforcing the ones the city already has. How about enforcing the overcapacity in all the buildings in the city that now have become boarding houses? Or how about trash bin overflows? or how about illegal parking on the front and side yards or the illegal Airbnb or the drug and gang houses in the city? I don't believe you have enough information to make a decision on the fair wages. I don't believe there was any outreach to the businesses in Everett to find out how it would impact them. How many other cities have done this and what have what has happened to their what are the results in their towns and cities? Next, regarding all the spending and borrowing.

Before spending any money or borrowing, I asked the council and Mayor Van Campen Back in December, you all voted to move $6 million from free cash to raise our taxes on an average of about $1,000 for the next two quarters. And all we are asking for is what caused the shortfall. You voted for it, you should know. I do want to commend the fire department for providing some backup for the funds they are requesting to save money for the future. Next, regarding the Chelsea Park and other expenses. A day doesn't pass where you hear or read about cities and towns freezing jobs, laying people off, freezing spending, cutting budgets, and voting on Prop 2.5 just to balance 2026's budgets. In 2024, DeMaria at the State House hearing about removing the DPA designation stated the city was short over $20 million in tax revenue. Some of you were there at that meeting. But in Everett, it's business as usual.

Spend, baby, spend. Remember, our taxes have more than doubled over the past 10 years, and the council approves the budget. The Chelsea Street... Going on to... Okay. Good evening. It appears the city council and the mayor have forgotten about the $180,000 that Di Maria stole from the city. Well, we haven't. DiMaria dropped his lawsuit against the IG's office back in December. So where is the effort by the city to get the money back? Why isn't the city filing criminal charges against Di Maria and anyone involved with the theft of $180,000? It was a big deal last year. Why isn't it now? Next, not sure if you have read the stadium agreement. From my understanding, Everett is getting royally screwed again. I think the mayor and the city council should step up and block this from happening. It's not about wanting or not wanting the stadium. It's about tax revenue. Constellation for decades was paying $15 million a year.

Kraft will be paying $750,000 a year on land. the land will not be assessed for 10 more years and the stadium will not be assessed ever again Only the land and how disappointing not to see any of you in the mayor jumping up and down saying this is nuts and what can we do about it. This is a TIF agreement without having the TIF vote for it, the council vote for it. Last week there was a call on the silver line If you read the MBTA write-up, the stadium is referenced 54 times. The design includes taking a lane away for bikes. a dedicated line for the Silver Line down the center of Chelsea and 2nd to Broadway. The presenter said this design will cause more congestion but hopefully people will take public transportation or take the bridge or take Route 28. This is insane. I've asked the same questions for years. Why extend anything from Chelsea to Sullivan Square

So I think in short time you guys should have an ordinance before you regarding banning data center construction in the city of Everett. you guys have heard me advocate for lots of other development in the city it's not that I'm anti development I just think that this is super damaging for our air quality for noise pollution for our water security and again utility rates of up to 25% being hiked. So please, when that is before you, vote to ban data centers from being constructed in the city. The Davis Company asked for the opportunity to present and make their case and they hired Cisco developer to do that, they were extremely misleading in their presentation stating that it would only increase electric rates regionally were a part of the region, news flash, saying that the data center in Downtown Crossing is small.

It's 30 megawatts. It's classified as a medium-sized. Data Center. Just lots of misinformation and lying by omission that really just makes me question Their intentions, anyway please just don't let a data center be built here. I sent you guys previously a data packet that included a bunch of information that you guys can can look up and verify your own sources. If you want to meet with me one-on-one and have a discussion about that, happy to sit down and do that if you guys have questions. I think over time we'll have federal and state regulations that will force state centers to be built responsibly in a way that won't impact you know rate payers as much and we'll have more environmental concern but I think you're putting the cart before the horse letting this be built in your backyard before there's any protections in place for residents and consumers so please just vote to ban it

Good evening. Thanks for having me. I've got a few issues, so I'll try and get through them in the time. The first thing I have to say is I was just made aware yesterday from a friend that I There is a restaurant in Encore that I don't know if I can say their name, so I'm not going to name it. But their employees just recently voted to unionize. And less than a month later, they announced that they're going to close. and since the mayor, if I remember right, in his campaign mentioned that he used to be a labor attorney, I would hope that the city looks into this and does what it can to help those employees out, maybe brings it up to the state. It seems like a blatant instance of union busting to me. The second thing is I also recently saw an article that National Grid wants to raise everybody's gas rates by 10%.

In the article that I saw, there's meetings being held by DPU. The closest meeting that I saw is on April 6th in Lynn. So I just wanted to make everybody aware of that because I don't want my rates going up 10 more percent, and I'm sure nobody else in this room wants that either. And then the last thing I'll say is I'll also speak to the data centers. I spoke out against it at the planning board meeting a couple of weeks ago. One thing I'll say is something that, you know, a lot of people talk about the energy consumption pollution, like environmental pollution, noise pollution, stuff like that. If you haven't heard, there have been reports that in the strike that Donald Trump did on Venezuela and in this war in Iran, they used AI to plan those missions.

Hi, my name is Alex Elsevar, and I promise I will be earlier next time. So this is not about the data center, but it will sound like it almost is. I spoke last time about this and I prepared a statement this time instead and sent it to all of you so you don't really have to listen. AI has become a controversial topic and in that controversy we have lost exactly Exactly what makes it so valuable to communities like the one we have in Everett. While corporate leaders and high-level government executives champion and leverage AI without issue, residents of a city like Everett are left with the political fallout, controversies over use of AI in schools, controversies over AI data centers and their environmental impact, which are real, and misplaced fears I have heard myself that using AI will feed it more information and let it take over.

But why should Everett leverage AI? AI can allow the rapid prototyping of custom software and web platforms that can provide real utility and opportunity to close-knit communities. In the old model of building software, the building and deployment of a web application required many resources and a large amount of money. The key thing now is that web applications only need to have champions, a community who supports the builders and users willing to engage with that platform. That's what's scarce. Everett has many incredible tight-knit communities, and both our young adults and our high schoolers have large networks of people who support their efforts.

The only thing that they need now to become entrepreneurs and creators of their own web platforms is a small amount of technical guidance, encouragement from their leaders and a space to collaborate on a regular basis. Just as we lead the state in building housing, we can do the same thing when it comes to building community-based web applications. Thank you.

I don't think the City of Everett can even enforce all of the different issues within this Woodman's suggestion. And I just want to say, too, that my father was a Local 7 iron worker. And before my father was an iron worker, he was out of work every winter, and we depended on relatives to take care of us. So I don't see this as just a union issue. I see it as there's only so many things we can do in our capacity as a city council and the state oversees a lot of it. So if we were to vote this in, what would we even be able to enforce? And then what are the subjective and objective standards? And are we opening ourselves up to unnecessary lawsuits?

This was in legislative affairs, and my understanding is that this isn't so much about the city's enforcement of this, but it does give us some teeth. There's a broader issue here that goes beyond the unions. As Councilor Capone mentioned, this can be related to sex trafficking. It can be related to immigration. So in order for the city to enforce it, it would have to be a scenario where it would have to be reported. So if there was a business that was violating this, it could bring it to our attention and we would have the teeth to then elevate it to the state, but it wouldn't really fall on us to be actually going around to enforce it on our own as a city.

Madam President, on the motion, so again, to echo Council Rogers' point, this is not about the city enforcing. The Attorney General is the entity that's enforcing. What we're doing is, as a city, we're choosing not to do business with contractors and businesses that have been reported to have a judgment or being debarred because they're violating. And what we are doing as a city is we have it on the ordinance. We're requiring contractors to maintain industrial accident insurance coverage. We're asking them to properly classify employees, maintain daily sign-in and sign-out logs, Comply with healthcare reform law, submit monthly certified payroll records. So we're just creating standards for them to be able to get into a contract with us and we're also creating a reporting system where Employees can report violations. It does affect especially non-union employees because the unions do a great job at protecting people.

and we have the ability to revoke a contract suspend the contract or impose additional conditions such as a wage bond. As far as lawsuits I believe that A developer or a contractor that's in the wrong, it'll be cheaper and the best option to just pay the employee instead of fighting the city. But as a city, are we not going to do the right thing because someone's going to sue us? That's not... are all acceptable. That's what I'm going to say for now.

And there's also something under agency law that if we hold ourselves of having authority that we don't, we can be sued. and we do represent all of the residents in Everett and we try to prevent lawsuits so they don't have to pay unnecessary money and our tax is going up again. And it would be to the president's discretion They want to take agenda or non-agenda, or if you even want to consider that. However, everybody gets three minutes. Freedom of speech. They can speak on whatever subject they want, whether it's on the agenda or not. For instance, we recently had a woman come up here who wanted to speak about the snowstorm. She had to wait till the end of the meeting. So this is actually making it more efficient by making sure that everybody has a chance at the beginning of the meeting to speak rather than depending on the discretion of the president forcing some people to wait an entire meeting to speak.

So essentially it was, if I may, It isn't taking away time. It's just consolidating to one list, which it used to be a long time ago. Same to the school committee. So as it stands, My interpretation is that the agenda and non-agenda were never meant to be four minutes. It's just that that's what happened because you were trying to separate agenda and non-agenda. So this is... a compromise, so to speak, to consolidate it and allow people. It's actually gaining the agenda items a minute. or either item. So if anything, residents that are only signing into one sheet, which is the average speaker who isn't familiar with the rules, is actually gaining a minute on whatever topic they would like.

Sometimes we've seen instances where somebody comes up for agenda, only and they speak two minutes and then we've had other instances where somebody signs up for non-agenda and they've had to wait till the end of the meeting so that's what we're trying to make less confusing. We put a lot of effort into accommodating various languages and braille. And then we make this confusing system that really isn't accessible. So we're trying to make it as accessible as possible. The goal was never to have people speak for four minutes. It was always originally two minutes but now you can use three minutes to speak on whatever topic you would like.

So some of them, if you see a grant, not all the time, but many of the times, it was a condition of the approval of that building to help mitigate traffic, and that's why they're adding them. Planning Board's approval process or zoning board, they're going to require them to have bikes near so that we can have less vehicles. Just because I've been at the meetings.
