Thank you, Madam Chair, members of the board. A couple of items for you. for you this evening. First, I wanted to give a little update on snow removal operations and a shout out to the DPW and all the contractors and everyone else who worked hard throughout the storm to to really deal with something that was somewhat extraordinary. We haven't had this much snow in a long time and it came down fast and exceeded expectations. So again, big shout out to Joe Flanagan and the team who really worked really around the clock to do the best they could with really limited resources. compared to a few years ago where we used to have 40 to 50 contractors. Joe says we have about 23 contractors now, so that's difficult, and many communities are

sort of struggling with the same thing, trying to recruit and retain the pieces of equipment that we need. So that obviously does slow down progress a little bit, is having less pieces of equipment out there and less personnel in the field, and we're doing our best to attract and retain those essential pieces, but it is a struggle. We're continuing those snow operations throughout this week. You saw last night we had the snow emergency in the parking. restrictions posted again. We'll be out again this evening trying to clean up those main thoroughfares and the piles of snow that were made throughout the community to, again, free up space, make sure that folks can get around and walk and park and just make things safe again. Again, appreciate everyone's patience with that. We're looking to make a lot more progress tonight and encourage folks to continue to reach out to us, let us know about areas that they see that need attention so that we can get there and prioritize those.

So Chair, I think that Joe and the DPW and everybody doing a did an amazing job, as is Public Safety, Police, Fire, Dispatch, EMS, and this was a tough storm. And I know people are frustrated, especially they're frustrated with sidewalks. on the main fairs, but if you go to the neighborhoods, a lot of sidewalks are clear because people go out of their house and shovel their sidewalks. There's nothing to prevent anybody that lives on a main road from trying to shovel the sidewalks. We have no requirement to do it, but it definitely would be a help. And I know that we're down to, I think, one sidewalk plow and one operator, so it's difficult. Hats off to Joe. It's a no-win situation when people are frustrated that they can't walk on sidewalks.

Madam Chair, if I might, I just want to echo that and also just remind people this was a top 10 snowstorm in the history of the greater Boston area. This was, I think, number eight on the list. So, you know, they worked so hard. but they can't wave a magic wand and make the snow go away. And I think one of the things personally I've realized with this storm is how deconditioned we've become to this kind of weather because it used to be like this all the time. and we used to get a lot of snow and I think the last few years we've gotten a lot less and we've gotten a little bit maybe spoiled with not getting some of the bad traditional New England winters, but certainly when we get this kind of weather, there's only so much they can do, and I think they've done everything they can do, so thank you to the DPW, Joe, all our public safety people, Water Commission, everyone.

Yeah, to be clear, so snow and ice is one of the few areas that we do have some budget flexibility, so we obviously appropriate funds every year, but we are, We exceed those funds. We are allowed to deficit spend because obviously this is an emergency. You have to have clear ways. and we do, it's not the funding side, it really is the availability of vendors and pieces of equipment and personnel and again maybe due to the milder winters folks have gotten out of the business. It's expensive to maintain insurance and that kind of equipment and when there's less snow it's harder to recoup those costs. I think that's a lot of what's driving that lack of availability and talking to folks. And again, Joe reports that many of the DPWs in the neighboring towns struggling with the same recruitment issues. And again, we're doing the best we can with the amount of resources we have available.

Our personnel levels are about equal to where they have been historically. It's more the vendors who tend to be construction companies historically had done that, where they slowed down sometimes in the wintertime. They would pivot to snow plowing. Now, again, I'm hearing this through multiple sources, but that the milder winters allow contractors to work through the winter now. and so they're focused less on the plowing and they can work construction. Same thing like the landscaping companies have sort of pulled back. They're doing less of the plowing and just again because maintaining that extra equipment and the personnel and the insurance is just very expensive given you know even though we're paying good competitive rates on an hourly basis it's just not worth it to them to come out for a few storms a year.

Teehan. If I may, I'll move on to another topic. We had a budget forum last night that focused on the deficit reduction plan as well as the results of the National Community Survey. We held that at the Endicott Estate at 6 p.m. It was very well attended, 35 to 40 folks came out. I want to give thanks to the library who provided opportunities for children to be entertained and watched while their parents were able to attend the meeting and I think that was quite popular and folks appreciated that and and thanks to Amber and Amanda as well who helped run the meeting and provide for a couple of fun exercises that we did during it and also the deficit working group folks who were there, as well as yourself and others who came. I think it was a great meeting, very civil.

Folks, I think, expressed a lot of good ideas for ways to approach the deficit challenges that the town is facing. and I think it's a good part of this continuing conversation that we're hoping to have with the community where we can engage and be transparent around budget issues and again seek community input as we make some big decisions coming up here in the coming months. again that was a very good I think event and it was nice that we coupled it with a morning session that catered to a different segment of the community and just to remind everyone we still have the Be Heard project website up so folks who weren't able to make either can tune in and watch the recordings on Dedham TV, and then submit questions or comments through the Be Heard website as well, and we're listening to that website and we will respond. And then last but not least, I just want to give an update on the FY27 budget.

We're working town manager's office, finance, and departments to pull together the departmental request into the town manager's recommendation, which we'll will be getting finalized in the coming weeks here. At the last update, we talked about some of the things that were outstanding. Since then, the governor's budget was announced on January 23rd. unrestricted aid was proposed to increase about 2.5%. Chapter 70, which is school funding, proposed to increase about 1.2%. there are some other increases in some of the chargebacks associated with that so that the net state aid increase is about 1%. if you count in the chargebacks.

So again, that's maybe not as positive as we're looking forward to, but we're going to continue to monitor it because this is just the first step in the state budget process. just to remind everyone we're still waiting on our health insurance numbers which we expect to have in February, our liability insurance February, and we're finalizing our debt service numbers still too so there are some big big portions of the budget that are still outstanding that will come into focus in the coming weeks and will help us to finalize our strategy for the upcoming weeks. We've been having good conversations with the school department. They'll be voting on their recommendation next week, so we'll have that as well to work with. Yes, Sergeant Sullivan, representing the Dedham Police Department. On Monday, November 17th, at approximately 6 p.m., Officer Reilly and Officer Kozak conducted an alcohol compliance check at 761 Providence Highway, Plaza Liquor. An underage operative was used to conduct this check. The underage operative possesses a valid under 21 vertical Massachusetts driver's license. the underage operatives entered the establishment and proceeded to buy a 12-pack of Bud Light. The employee did request to see the operative's license. The employee looked at her license and proceeded to sell the 12-pack of Bud Light. At that time, Officer Kozak entered the Plaza Liquors and spoke with the employee and stated he does not work at the Plaza Liquors. It was just covering for the manager. all necessary alcohol compliance paperwork was filled out.

I have nothing to contravene anything that the officer said. I would say however that the person who was working at the time was basically a Temporary infill for Mr. Amin, who was sick at the time. And Mr. Patel is not available. He lives in California now, as a matter of fact. and this was a situation where Mr. Patel apparently asked for the license, looked at it and was satisfied. Obviously a lack of training. which we would like to remediate right now. I looked it up. And Massachusetts, you don't have to wait for a TIPS class anymore. You can do it online. cost $38 per person. And I'm suggesting, strongly suggesting, to the Amiens that

in the event they have anybody who's filling in, that that person be TIP certified. $38 per person. You've got 30 days to complete the course. You can do it online. You don't have to go to other classes anymore. The only state that still does that is Connecticut. but that's what we suggest for remediation. This is one of those things where somebody was filling in, was not properly trained or indoctrinated what they have to do, and they messed up, what can I say? And Mr. Patel is, like I said, he's out in California right now, so I can't come up with his explanation of how this happened, okay? but again, I have nothing to contravene anything the officer said.

And if he had known how to read a license and been trained to read a license, it never would have happened. So I just... I just hope that in the future that you are more judicious about who you trust with your business because at the end of the day, You know, it's you whose name is on the license. It's your business. It's your butt on the line, which I can respect. I have to make a payroll every week.

On Monday, November 17, 2025, at approximately 6.15, Officer O'Hilly and Officer Kozak were assigned to conduct alcohol compliance checks at 985 Providence Highway, Tavern in the Square. An underage operative was used to conduct this check. The underage operatives possessed a valid under 21 vertical Massachusetts license, entered the establishment, and ordered at high noon. The employee did request to see operative's license, then proceeded to serve her a high noon. At that time, Officer Kozak entered the establishment and requested to speak to the bartender and manager in private to gather necessary compliance paperwork. and the manager, Mark Strauss, did provide the employees ServSafe certification. All necessary paperwork was filled out for this incident.

Sure, I'm Stephanie Boudreau, Council for Tavern in the Square, Dedham, LLC, doing business at Tavern in the Square. And here with me this evening is Tom Weedlock, who's the manager of record. Thank you. I'll just briefly, we just want to briefly explain kind of what happened and give some background. In a moment Tom will share some background on the restaurant, talk about zero tolerance policy, and discuss the bartender and the circumstances for this incident. I just want to address a few issues for the board to consider while hearing from Tom. First, it's worth noting that the police have been into this restaurant on several occasions in the two years it's opened, and this is the first incident of underage drinking that they've been cited for. We also want to be transparent here.

I mentioned that in 2024, there was an ABCC violation with a over-served customer. it's the only violation this restaurant has had and that in that instance the bartender was immediately terminated and it turns out they were serving a friend of theirs So there were extenuating circumstances there. A one-day sentence has been served already for that incident. you know just briefly that the board is aware of how hard it is for restaurants to find good and reliable help and they have had these two really well-regarded bartenders working for them. And they both made mistakes. And unfortunately, the restaurant has to pay the price. But they train. They spend countless hours, countless dollars training. were still in situations like today. And finally, I'd just like to point out that the local regulations do provide the board with a great deal of discretion.

And I don't have an excuse as to why he checked that ID and didn't look at the date. I'm speechless. But again, we do have a zero tolerance policy. He was suspended immediately, requested a final check, and he was terminated three days later. So we had that final check. there's just no grounds for it. No matter how good of an employee or good of a person there is, it's just not acceptable for us. After the incident, we talked to the staff ad nauseum just about responsible alcohol service. It had been a topic since, probably early summer. Actually, if the board wanted to see it, I could pull these from our host stands. These are posted at the host stand, behind the bar, service stations. It's about responsible alcohol service.

how to check an ID, signs of intoxication, everything that we do to train the team. We go through an extensive training during their Initial training, it's ongoing throughout. Like I said, we've been talking about this. I have to update this because it does say today's date in 2004, which I pulled today, and I realize we're now in 2005. But it's just something that it's a hyper-focus for us. We've tried to be a strong member of the community. Fundraising, we did Tip a Cop with Sergeant Sullivan and some other police departments for Special Olympics. We do fundraisers for schools. Most recently we did one for the Dedham cheerleaders. Allie Kelvers, the coach of the the cheerleading team she's been was one of our opening bartenders still with us today after two and a half years we just booked another one for the end of February we've done a couple of elementary schools not only in Dedham but in the surrounding towns to generate funds for for them to kind of give back to the community

Sure, just comments. First of all, thanks, Council and Tom, for your comments. We understand how difficult the business is today. You have a very successful, busy place. And that's how, in my opinion, mistakes happen. is because everybody's running from one customer to the other. And while this was a one-time slip, whether you have meetings before every shift and stress to your employees how important it is. And I do know what the councilor, you mentioned, I wasn't gonna mention the ABCC report, but you mentioned it. So it was somebody that was drunk leaving the store and fell. And I believe it was an ABC investigator that was standing outside, sitting outside watching the place and saw it happen. That's completely unacceptable.

I mean, how does somebody get that drunk sitting at the bar? And I understand what the excuse was, but that goes to management. You can't be there 100 hours a week, but sometimes you have to. It's not only training your bartenders, but your managers to keep an eye on. You've got a great business. and you're a great part of the community. Good evening Madam Chair, Board Members. On behalf of the Planning Board and the Planning, Zoning, and Natural Resources, I'm seeking the Select Board's acceptance of a $105,000 State Grant for the Legacy Boulevard Mixed Use District Plan. And if I may, I'd like to give just a brief background to members and also the public. The Haley-Driscoll administration announced in late October 2025 the town of Dedham was awarded this $105,000 grant to update zoning in the Legacy Boulevard area. which you can see behind you, that's the study area, under the FY26 Community One Stop for Growth Program. Dedham's successful application to the One Stop Program signified the Commonwealth's continued support and importance of economic development in the town of Dedham. If you remember, also through this program the prior year, we received $1 million for

100% design of improving the infrastructure in and around Legacy Place. So the administration understands and wants to support all Dedham's efforts, and we will continue to seek their assistance. The town seeks to proactively create a plan to promote future economic growth, balance impacts, address the town's housing needs, while ensuring a stable commercial tax base. to develop the plan. The town will embark on a community planning process by hiring a consultant team. Currently that RFP for the consultant team is out. And I think already at least two dozen folks have expressed interest in it. to work with the town, planning board, and most importantly, an 11-member advisor committee. And of that 11-member advisor committee, one member would be from the select board. And I believe in your materials provided with you as the roles and responsibilities of that advisory committee.

The plan will include a market assessment, build out analysis to understand future growth, opportunities, constraints, and a comprehensive public engagement process. The results of the plan will be zoning and development guidelines submitted to the planning board for consideration. This study is expected to begin in the late spring of this year and conclude by summer of 2027.

If I may, Madam Chair, I just want to address, I know the board talked about some recent closings of some restaurants at the last meeting, and I know, I think you all wanted to hear what the department and the town are doing about it. of course any closing of our Dedham businesses is concerning especially when it comes to restaurants which serve great food and provide a community gathering space for all of them I've reached out to both owners we have Unos, noticed Kimco, the property owners, that they're going to be closing. And also we have beloved El Centro and our only barbecue restaurant, Blue Ribbon Barbecue, have both announced they're leaving. We always proactively work with our business community, whether it's trying to streamline permitting, improve the public realm, or reduce regulations to all of our businesses to make them successful here in the town.

When it comes to UNO, working with Kimco, they actually don't have a tenant lined up, though they're of course open to suggestions and they have brokers working on fulfilling that tenancy. I'm sure its location on Providence Highway and the many folks that travel to and fro, that will be an opportune place. I know some of my staff want a Chili's there, which seems to be the hip spot, but we'll see. and the other two establishments in Dedham Square. I believe there are tenants lined up waiting to go in those spaces. And this is a testament. I know the closings are, as I said, Nothing that we want to see, but 20 to 50 percent of restaurants within the first five years close. unfortunate. It's a tough business, as I'm sure the many restaurants that you deal with. It is a tough business. But as you've probably heard, our meals taxes are record numbers. Our restaurants are thriving.

And so that speaks to that there are already restaurants lined up to take those spaces. and I mean we are happy to work with any of those businesses to get through that permitting process hopefully they don't need a whole lot you know these are existing restaurants they'll probably need some fit outs and we'll ensure that Going through that process is smooth and they are open as soon as they can, as soon as they sign on the dotted line for the new tenancy.
